1. Introduction and Scope
MindFire Internet Solutions, Inc. (“MindFire,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information, and the choices and rights you have. It applies to mindfireinc.com and other MindFire websites that link to it, our platform and personalized microsites (PURLs/GURLs), our AI Voice Agent, and our sales, marketing, and support activities (collectively, the “Services”).
Please read this Policy together with any additional notice we provide at the point of collection.
2. Roles and Responsibilities
MindFire handles personal information in two distinct capacities, and it matters which applies:
- As a business/controller. When we operate our own websites and conduct our own sales, marketing, recruiting, and support, we decide how and why personal information is used. This Policy governs that activity.
- As a service provider/processor. When we host campaigns, personalized pages, attribution, and related Services on behalf of our clients, we process personal information only on that client’s instructions and for their purposes. In that case, the client’s own privacy policy governs, and this Policy does not apply. If you interact with a personalized page or campaign powered by MindFire and have questions about your data, please contact the organization that sent it to you; we will refer such requests to that client. Our handling of client data is governed by our Data Processing Agreement with the client.
Regardless of which role applies, all data that MindFire has access to is handled under the governance of our SOC 2 certification, including its confidentiality controls.
3. Personal Information We Collect
The categories of personal information we may collect, using the categories set out in the California Consumer Privacy Act (CCPA), include:
- Identifiers — name, postal address, email address, phone number, and online identifiers such as IP address and device/browser identifiers.
- Customer records — job title, company, billing details, and account/login credentials for our platform.
- Commercial information — products or services purchased or considered, and campaign or demo history.
- Internet or network activity — interactions with our sites and emails, pages viewed, and QR/PURL response data.
- Geolocation data — approximate location derived from IP address.
- Audio information — recordings or transcripts from our AI Voice Agent, where enabled and consented to.
- Professional information — for job applicants and business contacts.
- Inferences — drawn from the above to understand preferences and campaign performance.
- Sensitive personal information — we do not seek sensitive categories of personal information for our own purposes. Acting as a service provider on a client’s documented instructions, however, we may process sensitive personal information, including ethnicity and other demographic attributes, solely on the client’s behalf and limited to their purposes. We use such information only at a statistical level and not to identify individuals for our own purposes.
4. Sources of Personal Information
We collect personal information directly from you (forms, demos, account signup, support), automatically through cookies and similar technologies, from our clients and partners, and from service providers and publicly available information.
5. How We Use Personal Information
We use personal information for the following business and commercial purposes:
- To provide, operate, secure, and improve the Services and our platform.
- To respond to inquiries, schedule demos, and provide customer support.
- To send marketing and transactional communications you have not opted out of, including email and SMS (see the Text Messaging section).
- To measure and improve marketing and campaign performance, including attribution and analytics.
- To manage accounts, billing, and contracts, and to evaluate job applicants.
- To comply with legal obligations, enforce our agreements, and protect the rights, safety, and property of MindFire, our clients, and others.
6. Cookies, Analytics, and Online Tracking
We use cookies and similar technologies on our websites for essential functionality, preferences, analytics, and marketing. On the first visit, we present a consent banner that lets you accept or decline non-essential cookies; non-essential technologies are not loaded until you consent. You can change your choices at any time by visiting the Cookie Settings link.
We recognize and honor the Global Privacy Control (GPC) signal and adjust the browser consent behavior automatically. When a visitor has GPC enabled, we recognize the opt-out preference and block non-essential cookies and tracking scripts without requiring any further action from the visitor.
7. How We Disclose Personal Information
We do not disclose personal information except as described here. We may disclose it to:
- Service providers and subprocessors who perform services for us (including hosting, communications delivery, analytics, and technology providers), under contracts that restrict their use of the data.
- Our clients, where the information relates to their campaigns (in which case we act as their service provider).
- Professional advisors, and to authorities or others where required by law or to protect rights and safety.
- A successor entity in connection with a merger, acquisition, or sale of assets.
8. Do We “Sell” or “Share” Personal Information?
MindFire does not sell personal information for money. Under the CCPA’s broad definitions, some uses of online advertising or analytics cookies may be considered a “sale” or “share” (cross-context behavioral advertising). To the extent any such activity occurs, you may opt out using the Cookie Settings link, as mentioned in section 6, or by sending a GPC signal from your supported browser. We do not knowingly sell or share the personal information of consumers under 16 years of age.
9. Data Retention
We retain personal information for as long as needed to fulfill the purposes described in this Policy, to comply with legal, tax, and accounting obligations, and to resolve disputes and enforce agreements. Retention periods vary by data type and context.
10. Data Security
MindFire maintains an information-security program independently audited under SOC 2 Type II. Measures include encryption of data in transit and at rest, role-based access controls and multi-factor authentication, audit logging, logical isolation of client data, continuous monitoring, and regular testing. No method of transmission or storage is completely secure, but we work to protect your information and to respond promptly to incidents.
11. Your Privacy Rights
California (CCPA/CPRA)
If you are a California resident, you have the right to:
- Know and access the categories and specific pieces of personal information we have collected, the sources, purposes, and categories of recipients.
- Delete personal information we have collected from you, subject to exceptions.
- Correct inaccurate personal information.
- Opt out of the sale or sharing of personal information.
- Limit the use and disclosure of sensitive personal information.
- Not be discriminated against for exercising your rights.
Other U.S. State Privacy Rights
Residents of other states with comprehensive privacy laws (including Colorado, Connecticut, Virginia, Texas, Oregon, and others) have similar rights to access, correct, delete, and opt out of targeted advertising, sale, and certain profiling, and to appeal a decision on a request. We honor recognized universal opt-out mechanisms, including GPC, where required.
How to Exercise Your Rights
You may submit a request by emailing compliance@mindfireinc.com, using the Cookie Settings link mentioned in section 6, or calling (877) 560-3473. We will verify your request (and an authorized agent’s authority) before responding, and we will not discriminate against you for exercising your rights. If we decline, you may appeal by contacting us at the same address.
12. Sensitive Personal Information
We do not use or disclose sensitive personal information for purposes other than those permitted under applicable law, and we offer the right to limit its use where required. Where we process sensitive personal information (as mentioned in section 3 above) on behalf of a client, we do so only on the client’s instructions and under our DPA, and limited to a statistical level.
13. Text Messaging (SMS)
If you opt in to receive text messages from MindFire, you consent to receive recurring automated messages at the number provided. Message and data rates may apply; message frequency varies. Reply STOP to unsubscribe or HELP for help. Consent is not a condition of purchase. We do not share mobile opt-in data or consent with third parties for their marketing.
14. Children’s Privacy
Our Services are directed to businesses and are not intended for children. We do not knowingly collect personal information from children under 13 (or under 16 for sale/sharing) for our own purposes. Where clients use the Services in contexts that may involve minors (for example, education campaigns), the client is responsible for obtaining any required parental consents; we support age-appropriate handling as their service provider. If you believe a child has provided us with personal information, contact us, and we will delete it.
15. Third-Party Links and Embedded Content
Our sites may link to or embed third-party content (for example, video or demo players). Those third parties have their own privacy practices, and this Policy does not cover them.
16. International Users
MindFire is based in the United States and processes information in the U.S. If you access the Services from outside the U.S., you understand your information will be processed in the U.S., which may have different data-protection laws than those in your country.
17. Changes to This Policy
We may update this Policy from time to time. We will post the updated version with a new “Effective” date and, where required, provide additional notice.
